1. Acceptance of Terms
By accessing or using the Nexus website or service (“Service”), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service. These terms apply to all visitors, users, and approved fleet partners.
2. Nature of the Service
Nexus is an operational alert notification service designed to assist professional tow truck fleet operators by surfacing relevant incident information. The Service monitors publicly available traffic signals and delivers structured notifications to registered operators.
Important limitations: Nexus does not guarantee the accuracy, completeness, or timeliness of any alert. Incident alerts are derived from publicly available signals and are provided for informational purposes only. Users must exercise independent judgement when responding to any alert. We make no representations that the Service will detect every incident, provide earliest possible awareness, or that information will be current at the time of receipt.
3. Eligibility and Access
Access to the Service is granted solely at our discretion to approved fleet operators. Submitting a request does not guarantee access. We reserve the right to refuse, suspend, or revoke access at any time without cause or notice.
4. Permitted Use
You agree to use the Service only for lawful, legitimate fleet operations. You must not:
- Redistribute, resell, or share alert access with unauthorised parties
- Use alerts in any manner that violates road laws or emergency response regulations
- Attempt to reverse engineer or replicate the Service
- Use the Service in a manner that interferes with emergency services
- Misrepresent your fleet size, location, or operations when applying for access
5. No Guarantee of Results
We do not guarantee that use of the Service will result in any particular operational outcome, increased job volume, earlier arrival, or any other specific result. The Service is a tool — operational outcomes depend on many factors outside our control.
6. Road Safety
Users are responsible for complying with all applicable road laws at all times. Accident Sniffer alerts are not a directive to drive unsafely, exceed speed limits, or respond to incidents in a manner that creates additional hazards. You are solely responsible for how you respond to any alert.
7. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Nexus and its operators shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of or reliance on the Service, including but not limited to missed jobs, vehicle incidents, or data inaccuracies.
9. Governing Law
These terms are governed by the laws of Western Australia, Australia. Any disputes arising from or related to these terms shall be subject to the exclusive jurisdiction of the courts of Western Australia.
10. Modifications
We reserve the right to modify these Terms at any time. We will update the date at the top of this page. Continued use of the Service after modifications constitutes acceptance of the revised terms.
